ANJANA MISHRA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Balrampur P.S. Case No. 58 of 2015, registered for offences punishable under Sections 147, 148, 149, 452, 341, 323, 307, 380, 504, 506, 427of the Indian Penal Code. Learned counsel for the petitioner submits that save and except the petitioner no. 2, against whom it is alleged that he had torn the Sari of the daughter in law of the informant, so far as the other petitioners are concerned, there is general and omnibus allegations.

Learned counsel appearing on behalf of the State after

Patna High Court Cr.Misc. No.44299 of 2015 (5) dt.16-02-2016 2/2 perusal of the case diary submits that there is no further cogent material on record so as to implicate the present petitioners. It is further submitted that so far the petitioner no. 2 Abdul Rahim @ Md. Rahim is concerned, the story that he had torn the sari is also not found substantiated.

Considering the facts and circumstances and also that these petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Balrampur P.S. Case No. 58 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
