JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 10-01-2018 The petitioner has renewed the prayer for bail in connection with Dalsinghsarai P.S. Case No. 447 of 2013 (Sessions Trial No. 363 of 2017) registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

The prosecution case is that the petitioner strangulated the brother of the informant with a towel around his neck.

The prayer has been renewed on the ground that the petitioner is languishing in custody since 14.12.2013 and the trial has not concluded as yet.

The report of learned Presiding Officer, Fast Track Court-I, Samastipur dated 15.12.2017 kept at Flag 'A'

Patna High Court Cr.Misc. No.55626 of 2016 (3) dt.10-01-2018 2/2 reflects that two witnesses have already been examined, rest six witnesses including two doctors and two I.Os. are yet to be examined and the trial is likely to be concluded within a period of six months.

In view of the report of the learned trial Judge, this Court is not inclined to interfere. It is expected from S.P., Samastipur to produce the witnesses before the learned trial Court. Accordingly, this application is disposed of with liberty to the petitioner to renew the prayer for bail if the trial is not concluded within a period of six months.

Let a copy of the order be transmitted to S.P., Samastipur.
