JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2020 Heard Mr. Mritunjay Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner, who is in custody since 16.04.2020, seeks bail in connection with Bibhutipur P. S. Case No. 85 of 2020 dated 15.04.2020 instituted for offences under Sections 272, 273, 399 and 402 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the accusation that 61.920 litres of liquor was recovered from the fodder house of the petitioner.

It has been submitted that the recovery is from an

Patna High Court CR. MISC. No.20399 of 2020(2) dt.19-06-2020 2/2 open place which is accessible to all and sundry. The petitioner is a person of clean antecedents. Regard being had to the aforesaid facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Samastipur or successor Court, Muzaffarpur in connection with Bibhutipur P. S. Case No. 85 of 2020.

The petition stands allowed.
