The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 341, 457, 380, 387 and 506 of the Indian Penal Code and 27 of the Arms Act. Allegation has been made that petitioner along with other co-accused persons have committed theft in the night. In the morning they have also committed theft and carried away the articles. All of them were armed with revolver and they were demanding extortion money.

Learned counsel for the petitioner submits petitioner is a Government employee aged about 70 years, not supposed to commit theft at this age.

Patna High Court Cr.Misc. No.21663 of 2017 (3) dt.19-08-2017 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Mahendra Singh, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with BodhGaya P.S. Case No.512 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that if the petitioners will not cooperate during course of investigation and join for interrogation the police will be at liberty to file an application for cancellation of bail.
