====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-10-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Rafiganj Police Station Case No. 270 of 2020 registered for the offences punishable under sections 304B, 498A/34 of the Indian Penal Code.

As per the prosecution case, petitioner and his family members killed the informant's daughter Puja Kumari by hanging her for non-fulfilment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is the husband of the deceased and during course of investigation it has come that the petitioner and the victim were living separately from other family members and

Patna High Court CR. MISC. No.31689 of 2021(3) dt.05-10-2021 2/2 when the victim was found in touch with some other boy of her maika and used to talk with him though the same was objected. As a result, out of anger she committed suicide. Petitioner is in custody since 2.1.2020.

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation that the petitioner used to demand dowry and commit torture on her and in league with his family members killed his wife in a planned conspiracy.

In view of the specific allegation against the petitioner as well as the fact that the informant's daughter died within seven years of marriage under unnatural circumstance and the petitioner is the husband of the deceased, his prayer for bail is refused.
