2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 323, 448, 307, 337, 379, 504 and 506 of the Indian Penal Code.

3. The case of prosecution is that on 22.11.2023, the petitioner along with other accused persons came and started assaulting to the informant and his father as well as his brother. In the alleged occurrence, the informant along with his family members sustained injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

There is case and counter case between the parties and both parties have sustained injuries as alleged in separate occurrence. General and omnibus allegation of assaulting has been levelled against the petitioner. Similarly situated other co-accused person has already been granted bail by this Court vide Annexure-P/3 of this petition. Moreover, the petitioner is languishing in judicial custody since 23.01.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muffasil P.S. Case No. 395 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st Nawada.
