JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The application is for grant of regular bail in connection with Kudra P.S. Case No. 282 of 2016 registered for offences under Sections 30(a)/38 of Bihar Prohibition & Excise Act, 2016. It has been submitted on behalf of the petitioner that only 13 litres of country made liquor alleged to be recovered from the possession of the petitioner and he is in custody for more than two months.
Heard learned A.P.P. also.
Having heard both sides. From the perusal of the record, it appears that this is third case under the Excise Act in which the petitioner is accused. Considering the aforesaid fact, I am not inclined to grant bail to the petitioner.
However, the court below is directed to expedite the trial
Patna High Court Cr.Misc. No.54710 of 2016 (3) dt.31-01-2017 2/2 by conducting the same on day to day basis and conclude it within a period of six months from the date of receipt/production of a copy of this order by the court below. If the trial is not concluded within the aforesaid period, the petitioner is at liberty to renew his prayer for bail.
