The petitioner, namely, Hafudin Mian @ Haffuddin Mian apprehends his arrest in Barauli P.S. Case No. 195 of 2015 under Sections 406, 302 and 201 of the Indian Penal Code.
The informant alleged that the petitioner took her husband to Nagpur for engagement on contract work but the husband of the petitioner did not return. The informant alleged that the petitioner might have killed her husband in order to grab wages of her husband.
Learned counsel for the petitioner submits that some of the witnesses disclosed altogether different facts that the husband of the informant came to his village after taking money
Patna High Court Cr.Misc. No.40666 of 2016 (4) dt.28-10-2016 2/2 from the petitioner. The petitioner also filed Manjhagarh P.S. Case No. 214 of 2015 under Sections 388 and 406/34 of the Indian Penal Code. It is submitted that the husband of the informant works somewhere in Maharashtra.
It is appears that the petitioner took the husband of the informant for his engagement on contract work, but thereafter, the husband of the informant is traceless and is still missing.
Considering the facts aforesaid, I am not inclined to enlarge the abovenamed petitioner on anticipatory bail and, accordingly, the same is rejected.
