It is submitted that after the selection of the petitioner as Sevika qua the Anganwari Centre situated at Patuaha (Kadam Tola) was set aside by the District Programme Officer, Saharsa by an order dated 04.05.2009, the petitioner had challenged the said order dated 04.05.2009 by

Patna High Court CWJC No.21558 of 2014 dt.16-08-2023 2/3 filing an appeal bearing Appeal No.09 of 2009, which has been disposed off by the District Magistrate, Saharsa by an order dated 01.02.2011, whereby and whereunder the entire selection process dated 18.05.2007, with respect to appointment of Sevika, pertaining to the Centre in question has been set aside and the Child Development Project Officer, Kahra has been directed to take steps to prepare the mapping register and thereafter, initiate selection process by inviting fresh applications for appointment of Sevika at the centre in question. It is further submitted that the aforesaid order dated 01.02.2011 has also been upheld by the Commissioner, Koshi Division, Saharsa by an order dated 21.12.2013, hence it is imperative for the respondents to comply with the aforesaid order dated 01.02.2011, passed by the District Magistrate, Saharsa.

Per contra, the learned counsel for the respondent-State has submitted that if the aforesaid order dated 01.02.2011 passed by the District Magistrate, Saharsa has not been
