In this case, the petitioner is seeking anticipatory bail in connection with Ram Krishna Nagar P.S. Case No. 298 of 2018, registered for the offence under Sections 302, 201, 307 and 120(B) of the Indian Penal Code.
The informant was the driver of one Uttam Kumar, who was engaged in liquor business. On the fateful day, the informant and Uttam Kumar had gone to Patna on a motorcycle for collecting a Car and Rs.4,00,000/- from the petitioner. When they reached Patna, the petitioner and his brother asked him to go Jaganpura, where they will pay the money. Thereafter, the informant and said Uttam Kumar went along with them. After
Patna High Court CR. MISC. No.21302 of 2019(2) dt.05-04-2019 2/2 some time, Uttam Kumar went along with Manish Kumar, Prem Raj and one other person. At that time, Anish Kumar and other three persons remained with the informant, after a while, started inflicting indiscriminate knife blow to the informant. At that time, one of the miscreants made a phone call to someone and said that they have killed the informant, so you will kill Uttam Kumar and whereafter they left the place thinking that the informant has died.
As the petitioner has a criminal antecedent, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
