The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
The prosecution case is that the miscreants entered into the house of the informant and robbed the informant leading to the registration of the FIR against unknown. The name of the petitioner sprang up during investigation on confession of the co-accused.
It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and a statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.41713 of 2015 (2) dt.08-10-2015 2/2 petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barharia P.S. Case No. 550 of 2014 pending in the court of learned Chief Judicial Magistrate, Siwan.
With the aforesaid observation, this application is disposed of.
