Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Petitioner is the husband of the victim-lady who died within seven years of her marriage in her matrimonial house in unnatural circumstances. There is allegation of demand of dowry and torture for the same. Petitioner is in custody since 16.01.2016.
Report of the court below dated 8th February, 2017, reveals that the case has not been committed to the Court of Sessions for trial as yet due to non-supply of police paper to the accused person.
Patna High Court Cr.Misc. No.42897 of 2016 (5) dt.13-02-2017 2/2 Let attention of the learned District Judge be drawn so that police paper may be supplied at the earliest and all steps be taken for conclusion of the trial within a period of nine months from the date of commencement of the trial, failing which the petitioner shall be at liberty to renew his prayer for bail. With the aforesaid observation, prayer for bail is refused, in connection with Belsand Police Station Case No. 06 of 2016 pending in the Court of learned Chief Judicial Magistrate, Sitamarhi, for the present.
