Learned counsel for the petitioner submits that the petitioner has antecedent of one case and his name transpired based on confessional statement of co-accused Pramod Rai in police custody in pursuance whereof the house of the petitioner was raided and a country made pistol from his room was recovered.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that one Pramod Kumar Sudhanshu had signed on the seizure list with whom the petitioner is on an inimical term, as such, he has been falsely implicated in the case, it is further submitted that the petitioner is a farmer.

Patna High Court CR. MISC. No.22945 of 2023(2) dt.12-07-2023 2/2 Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner and submits that the petitioner has antecedent of one case under the Arms Act and further there is allegation of recovery from his house in pursuance of confession of the accused who was apprehended by the police. Considering the submissions made by the learned A.P.P. for the State, the court is not inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail to the petitioner stands rejected.
