The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 365, 366A, 370, 370A, 372, 373, 376, 120B/ 34 of the Indian Penal Code and Sections 3, 4, 5, 6 of Immoral Traffic Prevention Act and Sections 4/6 of the POCSO Act and Sections 75, 79 of JJ Act.

As per FIR, the allegation against the accused persons including this petitioner is that they were apprehended on the spot and upon interrogation, it was found that they were forcibly taking some minor girls and

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner lives in a rented house and merely on the basis of suspicion she has falsely been implicated in this case. The petitioner has no concern with the alleged occurrence and there is no specific allegation of immoral trafficking attributed against her and nothing incriminating article has been recovered from her conscious possession. She has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 19.01.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sitamarhi P.S. Case No. 46 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
