The petitioner apprehends his arrest in connection with Dehri (Dalmiyanagar) P.S. Case No. 51 of 2016, registered for the offences punishable under Sections 420, 406, 323, 504 of the Indian Penal Code.
Allegedly, the informant gave Rs. 80,000/- to the petitioner for engaging her husband in the work of boot polish at Mumbai Station and the amount was given for granting "Billa" (license) to work at Mumbai Station, but neither the work was given nor the amount is being returned.
Submission is of false implication and that the husband of the informant was granted membership of Dhanak Boot Polish Kamgar Co-operative Society Ltd., Mumbai on
Patna High Court Cr.Misc. No.13566 of 2017 (3) dt.08-04-2017 2/2 16.10.2014 itself and he has worked there up to 22nd January, 2016 and thereafter the informant lodged this case on 23.01.2016. The petitioner has not taken any money and he has been made victim of the circumstances. From Annexure-2, series it is apparent that the husband of the informant was granted membership and he worked there till 22.01.2016 and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. after going through Annexure-2 series fairly submits that the husband of the informant was working at Mumbai.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri-on-sone, District- Rohtas, in connection with Dehri (Dalmiyanagar) P.S. Case No. 51 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
