2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302, 120(B) and 34 of the Indian Penal Code and section 27 of arms Act.

3 . Allegation against this petitioner is that he along with other co-accused persons under the conspiracy caused death of the deceased.

4. Learned counsel for the petitioner submits that Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., The name of the petitioner transpired during course of investigation on the basis of confessional statement of the co-accused persons and he has been assigned

Patna High Court CR. MISC. No.23943 of 2024(3) dt.03-05-2024 2/2 with the role of a liner. Except confessional statement, there is nothing on record to show the complicity of the petitioner in the present case . On the alleged date and time of occurrence petitioner was not present rather he was under the treatment of Dr. S.M. Alam. Chargesheet has already been submitted. He is in custody since 19.11.2023 .

5 Learned counsel for the State vehemently opposed the bail petition .

6. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed.

7. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate , Bikramganj , Rohtas in connection with Town Police Station Case No. 247 of 2023 .
