It is submitted by learned counsel for the petitioner that by order dated 19.6.2020, the petitioner was directed to be enlarged on provisional bail in connection with Chhattauni P.S. Case no. 338 of 2019 pending in the Court of learned 1st Additional District & Sessions Judge-cum-Special Judge, POCSO Act, East Champaran, Motihari. He has been so released. Although the affidavit etc. for removal of the defects pointed out by the office are ready, the physical functioning of the Court not having commenced, he is unable to file the same. Thus the defects could not be removed.

In the facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated 19.6.2020 in the instant case in connection with Chhattauni P.S.

Patna High Court CR. MISC. No.20034 of 2020(5) dt.08-02-2022 2/2 Case no. 338 of 2019 to the satisfaction of learned 1st Additional District & Sessions Judge-cum-Special Judge, POCSO Act, East Champaran, Motihari is hereby confirmed.

The petitioner is directed to remove the defects within four weeks of the normal physical functioning of the Court being restored.
