Heard learned counsel for the petitioners, learned APP along with Mr. Harsh Singh, learned counsel for OP No. 2. 2.
The petitioners in compliance of the order dated 31-10-2023 are present.

The learned counsel for the OP No. 2 submits that the OP No. 2 could not come to the court on account of her advanced age. The learned counsel for the OP No. 2 next submits that he has instructions to make submissions that OP No. 2 does not oppose the quashing application, as the dispute in between the petitioners and the OP No. 2 has been compromised. It is further submitted that petitioner No. 2 is son of OP No. 2 and petitioner No. 1 is her daughter-in-law. 4.
The learned counsel for the petitioners also concurs
Patna High Court CR. MISC. No.22103 of 2017(5) dt.07-11-2023 2/2 with the submission of the learned counsel for the OP No. 2. 5.
In view of the joint submission made by the learned counsels for the parties, the order dated 28-3-2011/27-1-2017 passed by the learned CJM, Gaya in Civil Line PS case No. 347 of 2010 whereby cognizance of offences under section 341, 323 and 34 of the IPC has been taken, is hereby quashed. 6.
The personal appearance of the petitioners is dispensed.
