Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code.

No doubt, petitioner is named in the first information report but none has seen actual killing of the deceased and in course of investigation, some witnesses stated only to this extent that the petitioner was seen standing in a street at the time of alleged occurrence. Moreover, the petitioner is languishing in jail custody since 29-08-2016 and the land dispute as well as previous enmity is admitted between the parties.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner
