Petitioner, who is in custody, seeks bail in connection with Nanpur P.S. Case No. 304 of 2018 registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Allegation against petitioner is recovery of 14.400 liters of foreign liquor from scooty, which was being carried by petitioner.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case due to enmity. Neither liquor nor scooty belongs to him and. He was arrested because he was passing on near the scooty and on
Patna High Court Cr.Misc. No.69502 of 2018(2) dt.04-12-2018 2/2 the basis of suspicion. He has not criminal antecedent and he is in custody since 1709.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Nanpur P.S.
