The petitioner apprehends his arrest in Darbhanga Town P.S. Case No. 101/2014, registered for the offences punishable under Section 366A and other sections of the Indian Penal Code. The informant named the petitioner during the course of investigation. The victim made her statement under Section 164 of Cr. P.C. and she has very categorically stated that the petitioner and his brother kidnapped her and took to Raxaul while she was going to school. The victim is a minor girl.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender

Patna High Court Cr.Misc. No.43017 of 2015 (3) dt.08-12-2015 2/2 before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
