JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-307, 380, 436 & other minor sections of the Indian Penal Code, in which, later on Section-302 of the Indian Penal Code was also added.
Petitioners are said to have assaulted the informant as well as his son, as a result whereof, informant's son died in course of treatment. It is also stated that the informant's house was set on fire by FIR named accused.

No.46753 of 2016 (2) dt.25-10-2016 2/2 accused, Rakesh Das having more or less similar allegation, has already been granted privilege of bail by this court vide order dated 20-09-2016 passed in Cr. Misc. No. 28077 of 2016. It would appear from perusal of the record that the alleged occurrence took place on account of the land dispute and the investigation against petitioners has already been completed. Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sursand P.S. Case No. 24 of 2016 to the satisfaction of learned Chief Judicial Magistrate or his successor learned Judicial Magistrate, Sitamarhi.
