In this case, the petitioners are seeking anticipatory bail in connection with Banmankhi P.S. Case No.115 of 2018, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379 and 504 of the Indian Penal Code.

Allegation has been made that the co-accused including the petitioners have assaulted the informant's side with different weapons causing injury, however, learned counsel for the petitioners submits that there is case and counter case between the parties and the occurrence took place on account of

Patna High Court CR. MISC. No.22520 of 2019(2) dt.09-04-2019 2/2 admitted land dispute. The petitioners have got criminal antecedents.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners.

Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
