2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 69 of the B.N.S..

3. As per prosecution case, it is alleged that this petitioner gave a job to informant in his restaurant and thus she came in contact with co-accused Bipin Ravidas who on the pretext of marriage, established physical relations with the informant, took Rs. 50,000/- cash and refused to solemnize

Patna High Court CR. MISC. No.22002 of 2026(2) dt.15-04-2026 2/3 marriage. It is further alleged that thereafter, this petitioner ousted the informant from her job.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired during investigation. From bare perusal of the F.I.R. it is apparent that specific accusation of establishing physical relations on the false pretext of marriage is against co-accused Bipin Ravidas. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that name of petitioner transpired in this case during investigation and the victim, in her statement recorded under Section 183 of the B.N.S.S., has categorically stated that this petitioner gifted her clothes and told her to make physical relations with co-accused Bipin Ravidas.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation, gravity of offence and statement of the victim recorded under Section 183 of the B.N.S.S., the prayer for grant of anticipatory bail to the
