Petitioner happens to be elder brother-in-law of the deceased and is languishing in jail custody since 28.3.2016 in a case in which after investigation police submitted chargesheet for the offences punishable under sections 328, 304B/34 of the Indian Penal Code. The marriage of the deceased had taken place 6 years ago and after marriage, she gave birth to a child. Post mortem report of the deceased disclosed that no external injury was found on the person of the deceased. However, FSL report goes to show that celphos was found in viscera of the deceased.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ajay Kumar II, Judicial
