The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147/149/341/447/323/324/379/380/307/504/506 of the Indian Penal Code.

The petitioner allegedly caused injury at the head of the informant. There is case and counter case. The petitioner has also sustained injury on non-vital part of the body. Submission is that the head injury on the injured, which was alleged against the petitioner, was simple in nature. Considering the fact that the petitioner had knowledge that his act might cause death, I am not inclined to grant

Patna High Court Cr.Misc. No.13756 of 2017 (2) dt.24-03-2017 2/2 anticipatory bail to the petitioner in connection with Jokihat Police Station Case No. 396 of 2016, pending in the Court of learned Additional Chief Judicial Magistrate-II, Araria/Successor Court. However, in the event of surrender, the prayer for regular bail of the petitioner shall be disposed of by learned Court-below without being prejudiced by the order of this Court.
