The petitioner apprehends arrest in a case registered for the offences punishable under sections 448, 354(1)(2)(A), 380 of the Indian Penal Code.
The informant made specific allegation that the petitioner entered into her house and tried to outrage her modesty. It is submitted that the petitioner happens to be own brother of the husband of the informant. Due to some family dispute this case has been lodged. The family members did not support the prosecution case.
It appears that the informant has made a specific allegation that the petitioner after entering into the house and
Patna High Court Cr.Misc. No.42545 of 2015 (3) dt.23-11-2015 finding her alone made attempt to outrage her modesty. Hence, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Rajauli P.S. Case No. 78 of 2015 pending in the court of the learned Chief Judicial Magistrate, Nawadah. His prayer for anticipatory bail is, accordingly, rejected.
