JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are languishing in custody inChapra Mufassil P.S. Case No.366/16 for offence punishable under Sections 47,47(A) and 48(2) of Bihar Excise Act. The allegation is that from a rickshaw 29 litres country made liquor was recovered. Seeing the police, both the petitioners started fleeing away but on chase they were arrested. The submission of the petitioners is that they are in custody since 7.10.2016 and have stated on oath that they have got no criminal antecedent.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.50729 of 2016 (2) dt.22-12-2016 2/2 let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Saran, at Chapra in Chapra Muffasil P.S. Case No.366/16.
