Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has preferred this application for grant of regular bail in connection with Hajipur Town P.S. Case No. 25 of 2022 dated 07.01.2022 registered for the offences punishable u/s 395 of the Indian Penal Code.

As per the prosecution case, 3 miscreants armed with guns entered the C.S.P. Centre and looted Rs. 77,410/-, some documents and utensils and fled away. But two miscreants were apprehended by the police, who disclosed their names as Manish Kumar and Shyam Babu. They also disclosed the name of the petitioner and the other co-accused persons who fled

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The name of the petitioner has surfaced on the basis of disclosure of the co-accused. The petitioner is accused in two more criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 20.09.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 25 of 2022.

The application stands allowed.
