====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-11-2020 Heard Mr. Raj Kumar, learned counsel for the petitioner and Mr. Bal Mukund Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Sasaram Dihri Case No. 203 of 2019 registered for the offences punishable under Sections 379 and 406 of the Indian Penal Code 1860.

The allegation as per the First Information Report is that the informant who was driver of Bolero vehicle parked his vehicle in the paid parking area at Sasaram Dihri Railway Station and took receipt from the petitioner and when he returned back, he did not find his vehicle in the parking area. It

Patna High Court CR. MISC. No.23974 of 2020(4) dt.11-11-2020 2/3 has further been alleged that petitioner, after hatching conspiracy with contractor Manoj Kumar, has stolen/misplaced the vehicle of the informant.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Learned counsel further submits that during course of investigation, it has not come that the petitioner was involved in the offence. However, the CC TV footage disclosed that the vehicle in question was being driven from the parking area, but the person, who was driving the vehicle, was not visible. Learned counsel also submits that petitioner has no criminal antecedent and he is in custody since 31.12.2019.

Having heard learned counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 31.12.2019, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Railway Magistrate, Gaya, in connection with Sasaram Dihri Case No. 203 of 2019.
