JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner, learned counsel for the State as also the learned counsel for the Informant. In this application for anticipatory bail the petitioner apprehends her arrest for the offences punishable under sections 448, 341, 324, 379, 307, and 504/34 of the I.P.C. The allegation against the petitioner is that she poured hot oil upon the informant during occurrence with an intention to kill her.

Submission is of false implication and that there is case and counter case bearing Town P.S. Case No. 207 of 2014 which has been lodged by Kiran Kumari against the prosecution party and due to dispute of house and land the informant lodged this false case. No such occurrence has taken place and vide

Patna High Court Cr.Misc. No.50582 of 2014 (2) dt.07-05-2015 2/2 Annexure-3 the injury found is simple caused by hard and blunt substance and no burn injury has been found.

The learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for pre-arrest bail by submitting that after death of husband of the informant the petitioner and others are trying their best to evict her from her house and they are committing occurrence after occurrence. Considering the injury found on the person of the informant which has been noticed simple caused by hard and blunt substance and as such the petitioner in case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Darbhanga in Town P.S. Case No. 205 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
