The petitioner seeks bail in Ramnagar P.S.Case No.53 of 2018 registered under Sections 302 and 120(B)/34 of the I.P.C.

Informant is the widow of the deceased who in his fard-e-beyan has stated that her husband had gone to the field for measurement of the land and after measurement while he was returning he was intercepted by son Ajimullah who torn the papers of measurement. Later on she was informed that her son Ajimullah and Kalimullah have assaulted her husband by dab causing injury on his head as a result of which he died. Patna High Court Cr.Misc. No.69758 of 2018(2) dt.06-12-2018 2/3 deceased who took out the papers and mobile from the pocket of the deceased. It has further been stated that due to property dispute her three sons had killed her husband. It has been submitted that there is no allegation of killing against the petitioner and allegation is only that he took out the papers and mobile from the pocket of her deceased husband. He is in jail custody since 16.08.2018 having no criminal antecedent.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Bagaha, West Champaran(Bettiah), in Ramnagar P.S.Case No.53 of 2018 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s. (iv) if the petitioners/s is found involved in similar nature of offences, after their release on bail the trial court shall take steps to cancel their bail
