JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

With an allegation that informant/ complainant Baby Devi was raped by the petitioner for which Paraiya P. S. Case No.65 of 2011 was registered and as per Annexure-2, the final report, it is evident that police concluded observing that the allegation happens to be false. Subsequently thereof, accepting the same, the learned lower Court proceeded on the basis of protest petition wherein ultimately cognizance was taken under Section 376 and 450 of the I.P.C. and on account thereof, petitioner happens to be under custody since 19.09.2016. Apart from this, from Annexure-3, it is evident that matter has been compromised

Patna High Court Cr.Misc. No.51693 of 2016 (02) dt.01-12-2016 amongst the party though not entertainable in the eye of law. In the aforesaid facts and circumstances of the case, petitioner, Pintu Ravidas is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. P. K. Sinha, Judicial Magistrate, 1st Class, Gaya in connection with Trial No.917 of 2015 arising out of Protest Complaint Case No.2058 of 2012.
