The Petitioner in this case is aggrieved by and dissatisfied with the order as contained in memo no. 1326 dated 09.10.2018 issued by the Sub Divisional Officer, Naugachia (respondent no. 4). By the impugned order the P.D.S. shop license of the petitioner has been cancelled. Learned counsel for the petitioner submits that against the impugned order he has preferred a statutory appeal before the Collector cum District Magistrate, Bhagalpur (respondent no. 3) but the same is still pending before the Collector cum

Patna High Court CWJC No.6076 of 2019(2) dt.27-07-2019 2/2 District Magistrate, Bhagalpur.

It is submitted that in this circumstance the Collector cum District Magistrate, Bhagalpur may be directed to consider and dispose of the Supply (PDS) Appeal No. 193 of 2018 and pass a reasoned order thereon after hearing the petitioner. Learned counsel for the State has no objection to the same.

This writ application is being disposed of with a direction to the Collector cum District Magistrate, Bhagalpur to consider, hear and dispose of Supply (PDS) Appeal No. 193 of 2018 within a reasonable period and in any case within three months from the date of receipt/production a copy of this order.
