Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Naubatpur P.S. Case No. 687 of 2015, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Earlier the prayer for bail of the petitioner was rejected four times. This is fifth attempt. Last time prayer for bail of the petitioner was rejected vide order dated 23.06. 2020 with liberty to the petitioner that if the trial is not concluded within six months from the date of production of copy of this

Patna High Court CR. MISC. No.33202 of 2021(3) dt.21-09-2021 2/2 order, the petitioner may renew his prayer for bail. Trial court report reveals that charge has already been framed on 15.09.2018 and case is running for prosecution evidence and three witnesses out of total seven named in chargesheet is examined.

Considering the nature of allegation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial as early as possible.
