JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Prayer is for withdrawal of the application for anticipatory bail on behalf of petitioner no. 4, Sajiv Kumar @ Gonga, as he has already been arrested in this case.

Prayer is allowed.

Heard the learned counsel for the petitioners, the informant and the State.

This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 504, 307, 354, 379 and 34 of the Indian Penal Code.

The petitioners, namely, Udit Narayan Singh, Ashwani Kumar Singh, Pappu Kumar and Rajiv Kumar, are agnates of the informant. There general and omni bus allegation of commission of assault. Specific allegation of attempt to commit injury at the head of the informant is against Pappu Kumar though the doctor has found simple

Patna High Court Cr.Misc. No.7662 of 2017 (3) dt.03-03-2017 2/2 injury on the nose of the informant. There is allegation of commission of theft also.

The learned counsel for the informant opposed the prayer seriously on the ground that there is allegation of attempt to outrage the modesty of the female members of the family against some of the petitioners. Considering the aforesaid fact, the petitioners, namely, Udit Narayan Singh, Ashwani Kumar Singh, Pappu Kumar and Rajiv Kumar,in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Muffasil P.S. Case No. 473 of 2016 to the satisfaction of the Chief Judicial Magistrate, Begusarai, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
