Petitioner, who is in custody, seeks bail in connection with Ramgarh P.S. Case. No. 117 of 2018 (G.R. No. 1080 of 2018) registered for the offences punishable under Section 302 and 120 (B) of the Indian Penal Code.
Informant is the widow of deceased who in her fardbeyan has named many persons against whom she has suspicion committing murder of her husband. Petitioner is one of them.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion and except suspicion there is nothing against petitioner. It has been further
Patna High Court Cr.Misc. No.70658 of 2018(2) dt.10-12-2018 2/2 submitted that similarly placed co-accused has been granted bail by co-ordinate Bench of this Court as contained in Annexure-2 of the petition. He is in custody since 06.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each of the satisfaction of learned A.C.J.M.-1st, Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 117 of 2018 (G.R. No. 1080 of 2018) subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at the liberty to cancel his bail bond.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
