Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 14.12.2018 in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

The prosecution case is that on 13.07.2017 when the informant, Madhav Prasad was returning from Allahabad Bank, Bathnaha Branch by his motorcycle to Muzaffarpur, at around 8.35 P.M. near Korlahiya Camp bridge, eight miscreants came on motorcycles and robbed the informant's Rs. four thousand, two mobile phones and a Glamour motorcycle, leading to registration of the FIR against unknown. The name of the petitioner sprang up during investigation. The petitioner made confession before the police also.

Patna High Court CR. MISC. No.19523 of 2019(2) dt.01-04-2019 2/2 It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor the petitioner has been put on T.I. Parade and investigation has already been concluded.

Learned APP submits that the petitioner has serious criminal antecedent and he confessed his guilt before the police. Considering the fact that the material on record does not suggest that the petitioner has been put on T.I. Parade and the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 328 of 2017.

Since the petitioner is having serious criminal antecedent, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities; if the petitioner defaults for two consecutive occasions or gets involved in some serious nature of offence.
