JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was made accused on the basis that the informant identified the photographs of the petitioner and, furthermore, petitioner was remanded in this case in the year 2015 and taking note of the aforesaid facts, the prayer for bail of the petitioner was earlier rejected by this Court vide order dated 22.12.2015 passed in Criminal Misc. No.57578 of 2015, directing the trial court to conclude the trial of the petitioner within six months from the date of receipt/ production of a copy of the aforesaid order.

However, the impugned order goes to show that up till now, only one prosecution witness could be examined and the trial

Considering the aforesaid facts and circumstances as well as submissions of the parties, and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Session Judge-V Begusarai in connection with Sessions trial no. 533 of 2016 arising out of Begusarai Town P.S.Case No. 150 of 2009.
