Petitioners, who are in custody, seek bail in connection with Gopalganj P.S. Case No. 534 of 2018 registered for the offences punishable under Sections 147, 148, 149, 150, 152, 353, 504, 323, 307, 427 and 120B of the Indian Penal Code.
Informant is the Executive Officer, Nagar Parishad, Gopalganj, who in his written complaint address to Officer-incharge, police station had stated that on 13.09.2018 he was on encroachment removal drive and on 14.09.2018 at about 10:00
Patna High Court Cr.Misc. No.69501 of 2018(2) dt.04-12-2018 2/2 A.M., the owner of Santosh Medical was asked to remove the encroachment upon which he objected that first get the encroachment removed from Balaji Pharma and there was altercation between them. It is further alleged that thereafter they started abusing and assaulting the employee of corporation and also damage the vehicle.
It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They have falsely been implicated in this case only on suspicion. They are not named in FIR. They have no criminal antecedent and they are in custody since 24.09.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 534 of 2018.
