JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 A supplementary affidavit has been filed on behalf of the petitioner. In light of the supplementary affidavit, the petitioner is permitted to make correction in paragraph 3 of the main petition. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 366A of the I.P.C.
Allegation is that the accused persons including the petitioner kidnapped the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.12.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been recovered. Her statement has been recorded under
Patna High Court Cr.Misc. No.36263 of 2016 (3) dt.26-10-2016 Section 164 Cr.P.C. There is no allegation of any sexual or physical abuse against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Araria in connection with Jogbani P.S. case No.111 of 2015.
