The petitioners seek pre-arrest bail in connection with Jehanabad SC/ST P.S. Case No. 24/015 registered under Sections 341, 323, 308, 427, 504/34 of the Indian Penal Code and Section 3(1)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.
In view of the specific bar created under Section 18 of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, the present application under Section 438 Cr.
Patna High Court Cr.Misc. No.42512 of 2015 (2) dt.13-10-2015 2 / 2 P.C. is not maintainable.
Accordingly, the application is disposed of as not maintainable.
In case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
