The petitioner seeks bail in connection with Session Trial No. 52 of 2016 (arising out of Thakurganj P.S. Case No. 77 of 2008) registered for the offences punishable under Section 302, 328/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R. The other co-accused persons were named in the F.I.R. have already been acquitted vide order dated 30.07.2015 in Session Trial No. 1089 of 2008 and nothing has been recovered from the petitioner. The petitioner is the wife of the deceased and she re-married and she has no concerned with the present case.

Having heard both sides, upon perusal of the record it appears that the petitioner has been implicated in this case and pending in the court of S.T. No. 52 of 2016. I am not inclined to grant bail of the petitioner. The prayer for bail is rejected. However, considering the period of detention of the petitioner the learned trial court is directed to expedite the trial and to conclude the same as early as possible preferably within three months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may renew his prayer of bail.
