JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Excise Case No. 1279 of 2018 arising out of Barhara (Khawaspur) P.S. Case No. 315 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that two persons namely, Pravin Kumar and Manoj Singh have been apprehended by the police. They disclosed the name of this petitioner as a person who had run away from the place of occurrence. There is no recovery of any illicit liquor from possession of the petitioner. Counsel for the petitioner further submits that co-accused Pravin Kumar and Manoj Singh have already been granted bail by coordinate Bench of this Court vide order dated 6.10.2018 passed
Patna High Court Cr.Misc. No.66615 of 2018 (2) dt.06-11-2018 2/2 in Cr. Misc. 59050 of 2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur at Ara, in connection with Excise Case No. 1279 of 2018 arising out of Barhara (Khawaspur) P.S. Case No. 315 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
