Mr. Jay Narayan Thakur, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-08-2021 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State through virtual court proceeding.

The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 302, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

In pursuance to the order dated 28.07.2021, status report of trial in connection with Siwan Muffasil P.S. Case No. 510 of 2017 has been received and kept at Flag-X, in which it is stated that the charge has been framed on 10.08.2018 and case is running for prosecution evidence. It is further stated that out of eight prosecution witnesses four witnesses have been examined till date, informant is not produced before the court for examination. Last witness was examined on 06.10.2020, since

Patna High Court CR. MISC. No.32932 of 2021(3) dt.25-08-2021 2/2 then no witness has been produced by the prosecution. Next date is fixed for evidence on 25.08.2021 for examination of rest witnesses. Trial of this case may be concluded within four months after situation becomes normal and physical court resumes.

Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Siwan Muffasil P.S. Case No. 510 of 2017 pending before the court of the learned Additional District Judge-IX, Siwan.

Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of nine months from the date of initiation of normal physical proceeding and /or through Video Conferencing. Both parties are directed to cooperate in the trial. S.P., Siwan is also directed to produce the witnesses in the court on the date fixed so trial shall be concluded within the stipulated period.
