JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 376/34 of the IPC.

Petitioner and one co-accused is said to have raped the informant and accordingly, the First Information Report was lodged. However, when the statement of victim was recorded under Section 164 Cr.P.C., she failed to disclose the name of her rapist and taking note of the aforesaid fact, a co-ordinate Bench of this Court granted privilege of bail to co-accused Mannu Chaudhary vide order dated 19.09.2018 passed in Cri. Misc. Case No. 50642 of 2018.

Patna High Court Cr.Misc. No.66550 of 2018 (2) dt.22-11-2018 2/2 Considering the aforesaid facts and circumstances, as well as the submission of the parties, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Sub-Judge XV-cumA.C.J.M., Patna in Phulwarisharif (Janipur) P.S. Case No. 126 of 2018.
