Petitioner, who is in custody, seeks bail in connection with Special Case No. 73 of 2018 arising out of Jakkanpur P.S. Case No. 326 of 2018 registered for the offences punishable under Sections 20/22 of the NDPS Act. Allegation against petitioner is recovery of 1 kg 200 gm Ganja from the possession of the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to malafide intention. He was neither arrested on the spot nor any incriminating articles has been recovered from his possession. The allegation is false and
Patna High Court Cr.Misc. No.66685 of 2018(2) dt.22-11-2018 2/2 fabricated. He is only a tenant in the house of Bhola Rai. He has no criminal antecedent and he is in custody since 19.07.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, NDPS, Patna in connection with Special Case No. 73 of 2018 arising out of Jakkanpur P.S. Case No. 326 of 2018.
