2. The petitioner apprehends arrest in connection with Madhuban P.S. Case No. 290 of 2024 instituted under Sections 238, 3(5) of the Bhartiya Nyaya Sanhita and Section 25, 9, 27 of the Arms Act.

3. As per the prosecution case, the deceased was killed in celebratory firing. The petitioner is said to be present there.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

5. Considering the fact that there is no specific allegation against the petitioner, this application is allowed.

6. Accordingly, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Madhuban P.S. Case No. 290 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
