====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Tariyani P.S. Case No. 75 of 2018 instituted for the offence under Sections 366A, 363 and 34 of the Indian Penal Code.
Counsel for the petitioner submits that victim girl has given statement under Section 164 Cr. P.C. wherein she has not levelled any allegation of illegal act committed by this petitioner. The statement of victim girl has been enclosed as Annexure-2 wherein she has stated her age as 16 years. The court has assessed her age to be 17 years. She has stated in her statement recorded under Section 164 Cr. P.C. that petitioner took her on Motorcycle by pressing her mouth to different places. He performed court marriage with her in Sheohar. He
Patna High Court Cr.Misc. No.70969 of 2018(2) dt.10-12-2018 2/2 kept her in the house of his sister after performing marriage. Counsel for the informant has appeared and opposed the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar, Distt. Sheohar, in connection with Tariyani P.S. Case No. 75 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
