The petitioners are apprehending their arrest in connection with Hayaghat P.S.Case No.58 of 2015 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

Allegation against the petitioner nos. 2 and 3 is of assault by Khant and other petitioners are also named in the FIR. Submission of the learned counsel for the petitioners is that except the petitioner nos. 2 and 3 no specific allegation has been attributed against them and though the allegation against

Patna High Court CR. MISC. No.21650 of 2019(2) dt.10-05-2019 2/2 the petitioner nos. 2 and 3 is of assault but the injuries are simple in nature and there is case and counter case between the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Darbhanga in connection with Hayaghat P.S.Case No.58 of 2015 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
